Terms and conditions
1. Object
These general conditions of sale are intended to regulate the Terms and Conditions by which FASHIION LABBEL PORTUGAL LDA, with registered office at Avenida Infante D. João, Nº. 77, 2nd Left, 2890-097, Alcochete, legal entity with TAX Nº. 516166492 - hereinafter "MY GOJJI" and any user wishing to make a purchase through the website www.mygojji.com - hereinafter "user" shall be governed.
The MY GOJJI online store service consists in the availability and supply of a set of products, to allow the user to order and purchase online the products presented in it.
Using the website www.mygojji.com implies full acceptance and agreement of all parameters present in the Terms and Conditions described, as well as the Privacy Policy in effect at the time you access the online store.
If you do not accept, partially or fully, any of the conditions stipulated, you should not make purchases on the website www.mygojji.com. If you access the online store, you will be committed and responsible to respect the conditions set out in this page and the in Privacy Policy.
MY GOJJI reserves the right to update and change the Terms and Conditions without prior notice. You are advised to check the Terms and Conditions periodically to ascertain any changes or updates.
2. Product
MY GOJJI informs users about the features, descriptions and images of each product on each page available.
It undertakes to make its products available in a clear manner and to correct possible errors that may occur as soon as possible.
3. Order
All products available on MY GOJJI can be purchased, except in cases of stock shortage or limitation, as well as on made-to-order products, whose availability may be variable. Products may become unavailable without prior notice, but in these circumstances, they will be duly identified on MY GOJJI.
If the product is no longer available after the purchase has been concluded, MY GOJJI undertakes to contact the user by telephone or e-mail as soon as possible to speed up the process with the user.
3.1. Order cancellation
At user's request:
You may cancel an order you have placed while it is being processed within the timeframe stipulated in our policies (30 minutes after placing the order). You are requested to inform MY GOJJI via the following email contact: orders@mygojji.com quoting the order number.
By decision of MY GOJJI:
MY GOJJI reserves the right not to process any order or refund in cases of data inconsistency, fraud or misconduct of the user, as well as in case of errors in the values and/or characteristics of the products, when these are due to technical problems or errors beyond MY GOJJI's control.
4. Price and payment
MY GOJJI presents, in a concise manner, the prices of each product in euros (€), including the appropriate VAT rates and taxes in accordance with the law in force, shipping costs applied to each order and other additional costs that may be applicable.
Information about products, prices, contents, images, videos, and promotional campaigns may be updated and changed by MY GOJJI at any time.
The user has the following payment methods available: Credit Card, MBWAY, Paypal, Bank Transfer and Klarna.
After the payment is completed, MY GOJJI will proceed with a standard verification, to be able to process and send the order. You will receive an e-mail confirming that the order has been paid for, as well as the corresponding invoice.
5. Reservations
The website www.mygojji.com does not work with any possibility of reservation of any of the available products.
A product included in the shopping cart is not considered a reservation and does not prevent other users from purchasing it and it is sold out.
6. Returns
In accordance with Decree-Law No. 24/2014 of February 14, the user has the right to return within a maximum period of 14 (fourteen) calendar days from the day he/she acquires physical possession of the good.
If the user wishes to return a product, he/she may do so by emailing orders@mygojji.com or by filling out the contact form available at MY GOJJI website and will be informed by the same via the instructions to proceed with it.
The package must be returned complete, as delivered, and accompanied by all the documentation received, namely: labels, hygienic protections, bag, box and show no signs of use.
When returning a product within the legal deadline, in addition to shipping the product, you must return any gifts that accompany the main product.
You will be responsible for the postage costs incurred in sending the return.
Upon receipt of the return, we will refund to you the amount corresponding to the amount paid for the order (sales invoice value). If you have used a promotional discount code, this amount will not be refunded, i.e. the refund will only be for the amount actually paid.
The amount to be returned is refunded to the bank account indicated by the customer, as soon as the IBAN is provided.
MY GOJJI will refund the amount paid within 14 (fourteen) calendar days after receiving the returned products.
7. Exchanges
You have the right to exchange a product purchased on www.mygojji.com.
You may do so within a maximum period of 14 (fourteen) calendar days from the day on which you acquire physical possession of the good by emailing orders@mygojji.com or by completing the contact form available on MY GOJJI website and will be informed by the same via the instructions for proceed with it.
The package must be returned complete, as delivered and accompanied by all the documentation received, namely: labels, hygienic protections, bag, box and show no signs of minimal use.
No exchanges will be accepted for products that are in the following conditions:
- Bad use (damaged);
- Incorrect washing of the product.
The return shipping costs, as well as the shipping costs of the new product are the responsibility of the user.
8. Manufacturing defect
In case of a "manufacturing defect", i.e., when it is detected that the product does not conform to the characteristics of the order, the user must immediately contact MY GOJJI via e-mail orders@mygojji.com.
9. Responsability
By creating and using the MY GOJJI account, you are responsible for account maintenance, confidentiality and all activity arising from your account.
By creating an account and placing orders, you expressly and unequivocally accept the Terms and Conditions.
MY GOJJI is not responsible for any information disclosed by third parties, technical failures or any other problems that prevent access and proper operation of the online store.
MY GOJJI is not responsible for possible damages directly or indirectly related to the use, or inability to use, the products made available, as well as for any delay or unforeseen delay in the delivery of orders.
10. Customer obligations
The user undertakes to:
i) Provide correct personal data and addresses;
ii) Not to use false identities;
If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or eventual non-delivery, the user is responsible, and MY GOJJI declines any responsibility.
11. Processing of personal data
The data provided by users will be treated in accordance with the Privacy Policy, please check it.
12. Intellectual property
The online store MY GOJJI is a registered website, and the service provided by the responsibility of FASHIION LABBEL PORTUGAL LDA.
The content, domain, information present and available on the website www.mygojji.com are owned by FASHIION LABBEL PORTUGAL LDA, being thus protected by copyright and related rights. Any use, reproduction, copy or dissemination of visual, audiovisual, or written content is subject to prior approval by MY GOJJI.
The user undertakes to fully respect the above conditions and rights and to refrain from acts that may go against the law and rights such as copyright, related rights, among other legislation applicable to the use of images, videos, contents, etc. without the express approval of MY GOJJI. MY GOJJI shall not be held responsible for any misuse of such products.
13. Applicable law and jurisdiction
These conditions are governed by Portuguese law and current legislation.
